According to Wu Blockchain, Yang Zuoxing, founder and CEO of Shenma Mining Machine, was released on bail before the Spring Festival and is expected to enter the court review stage. In addition, in addition to the embezzlement crime approved by the Shenzhen Nanshan Procuratorate, the commercial secret infringement crime being investigated by Beijing Haidian District has not been closed, which means that Yang Zuoxing may be involved in two criminal cases at the same time, which makes the case extremely complicated.

It is reported that Yang Zuoxing was previously a chip engineer at Bitmain. In 2016, he failed to reach an agreement with Bitmain founder Zhan Ketuan due to equity issues. Yang Zuoxing himself recalled, "At that time, Wu Jihan was willing to give 2% of the shares, but Zhan Ketuan was only willing to give 0.5% of the shares." Yang Zuoxing left Bitmain for this reason, and then founded BitMicro and launched Shenma Mining Machine. Since its establishment, Shenma Mining Machine has quickly jumped to the second place in the industry at a rare speed. According to people familiar with the matter, Shenma Mining Machine is the mining machine giant second only to Bitmain, accounting for about 40% of the market share. Since then, Yang Zuoxing and Bitmain have been involved in a case dispute.

On July 27, 2017, a case involving Bitmain, Suanfeng Technology (Beijing) Co., Ltd., Yang Zuoxing and others on infringement of utility model rights was filed in the Urumqi Intermediate People's Court in Xinjiang. The dispute revolved around a new utility patent called "series power supply circuit, virtual digital currency mining machine and computer server", which was licensed by Suanfeng Technology to Beijing Bitmain Company in the form of ordinary implementation license. After the case was filed, Yang Zuoxing filed a request for invalidation of the patent involved in the case claimed by Bitmain to the Patent Reexamination Board of the State Intellectual Property Office.

In April 2018, the Patent Reexamination Board issued the "Invalidation Request Examination Decision", declaring the utility model patent No. 201520533250.1 invalid. As a result, the "patent" had no legal basis, and Bitmain lost the case. After that, Bitmain appealed again, and the case was filed on October 25, 2018, and the appeal was withdrawn on November 15.

After studying the case, it was found that Bitmain lost the case not because Yang Zuoxing or his company had sufficient evidence, but because the "patent" that Bitmain claimed to hold was not passed. According to the ruling, Suanfeng Technology Co., Ltd. is the patent owner of the utility model patent No. ZL201520533250.1 involved in the case. Suanfeng Technology Co., Ltd. licensed Beijing Bitmain to implement the patent in the form of a general implementation license. The defendant Yang Zuoxing worked in an affiliated company of Beijing Bitmain and was familiar with the patent involved. After Yang Zuoxing established Shenzhen BitMicro, he began to manufacture and sell a large number of "mining machines" that were suspected of infringement.

On November 8, 2019, multiple sources said that the boss of Shenma Mining Machine, Yang Zuoxing, had been taken away by the police for investigation, which might be related to the infringement of the trade secrets of a mining machine manufacturer.

On December 12, 2019, the Nanshan District Procuratorate of Shenzhen City published information on the China Procuratorate website: "Recently, our court approved the arrest of the criminal suspect Yang Mouxing for the crime of embezzlement. At present, the case is being further processed." After verification, Yang Mouxing in the article is Yang Zuoxing, the founder of Shenma Mining Machine. This time, the Shenzhen police detained Yang Zuoxing on suspicion of embezzlement of 100,000 yuan.


In response to this matter, Xiao Sa, director of the China Banking Law Research Association, said, "This time Bitmain chose another way to resolve its dispute with Shenma Mining Machine. Obviously, the criminal approach seems to be more likely to solve the problem."
